These Terms of Service (“Terms”) govern your use of Biplane Battle (the “Game”), developed and published by JoeBung Apps (“I”, “me”, or “my”). By downloading, installing, or playing the Game, you agree to be bound by these Terms.
If you do not agree to these Terms, do not download or play the Game.
These Terms should be read alongside my Privacy Policy, which explains how I handle your data.
Biplane Battle is a free-to-play mobile game available on the Apple App Store (iOS) and Google Play (Android). The Game is free to download and play. Optional in-app purchases are available and the Game contains rewarded video advertisements.
You do not purchase the Game itself. Downloading the Game grants you a limited, free licence to play it as described in Section 3.
Subject to your compliance with these Terms, I grant you a personal, non-exclusive, non-transferable, revocable, limited licence to download and play the Game on a device you own or control, for your own personal, non-commercial use.

This licence is provided at no charge. I reserve the right to revoke it at any time if you breach these Terms.
The Game offers optional in-app purchases (“IAPs”) such as premium content or virtual items. All purchases are processed entirely by Apple (App Store) or Google (Google Play) — I do not directly handle your payment card details or billing information at any point.
Because all payments are processed by Apple or Google, refund eligibility and handling is governed entirely by their respective store refund policies. I do not process refunds directly.
If you are experiencing a problem with the Game or a purchase, please contact me at joebungapps@gmail.com and I will do my best to help, though the final refund decision rests with Apple or Google.
If something went wrong with a purchase, I want to help — just email me. But because Apple and Google handle the payments, they are the ones who process any refunds. The links above go directly to their refund request pages.
The Game contains rewarded video advertisements. Watching ads is always voluntary — you choose to watch an ad in exchange for an in-game reward. You are never required to watch an advertisement to play the Game.
Ads are delivered through the following third-party ad networks operating within the Unity LevelPlay mediation platform:

These networks may use your Device Advertising ID (IDFA on iOS; GAID on Android) to serve and measure ads. On iOS 14.5 and later, the Game will ask for your permission via Apple’s App Tracking Transparency (ATT) prompt before any advertising ID is accessed. In the EEA and UK, consent is managed via Google’s User Messaging Platform (UMP) in accordance with the IAB TCF v2.2 framework.
You can opt out of interest-based advertising at any time through your device settings, or reset your Advertising ID. Full details are in the Privacy Policy.
Ads in this Game are optional — you choose to watch them to earn in-game rewards. I do not show you forced ads. The ad networks listed above handle the actual delivery of ads and may use your device’s resettable Advertising ID to do so.
All content in the Game — including but not limited to graphics, artwork, audio, music, code, game mechanics, and the Biplane Battle name and logo — is owned by JoeBung Apps and is protected by applicable copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of the Game without my express prior written permission.
Nothing in these Terms transfers any intellectual property rights to you. The limited licence in Section 3 is the only right granted to you.
When using the Game, you agree not to:
I reserve the right to take any action I deem appropriate in response to a breach of these rules, including revoking your licence to play the Game.
The Game is provided on an “as is” and “as available” basis, without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, I disclaim all warranties, including but not limited to:
Some jurisdictions do not allow the exclusion of implied warranties, so the above may not apply to you in full.
To the fullest extent permitted by applicable law, JoeBung Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Game — including but not limited to loss of data, loss of profits, or loss of in-game items or progress.
In any case, my total liability to you for any claim arising out of or relating to these Terms or the Game shall not exceed the amount you paid for in-app purchases in the thirty (30) days immediately prior to the event giving rise to the claim.
Some jurisdictions do not allow certain liability limitations, so the above may not apply to you in full.
The Game is not directed at children under 13 (or under 16 in the EEA and UK). If you are under the applicable age in your jurisdiction, you must have your parent or guardian’s permission before playing the Game or making any in-app purchase.
Parents and guardians are encouraged to use device parental controls to manage in-app spending and app access for minors.
I may update these Terms from time to time. When I do, I will update the “Last Updated” date at the top of this page. Continued use of the Game after any changes constitutes your acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the State of New Hampshire, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Hampshire.
If you are located in the European Economic Area or United Kingdom, you may also have rights under the mandatory consumer protection laws of your country of residence, which these Terms do not affect.
